These Terms govern your use of TapShift. By creating an account or using the platform, you agree to be bound by them.
TapShift is a job-matching platform that connects hospitality workers with businesses in Berlin. We facilitate discovery, communication, scheduling, and reviews — but we are not an employer, agency, or party to any agreement between users. All employment relationships exist directly between the worker and the business.
- You must be at least 18 years old and legally entitled to work in Germany to use TapShift.
- Workers must hold valid EU work eligibility before accepting any shift.
- Businesses must be authorized to hire staff and post shifts in Berlin.
- You are responsible for keeping your account credentials secure and for all activity under your account.
- TapShift verifies identity and eligibility, but does not guarantee the accuracy of user-submitted information beyond our verification checks.
- Businesses post jobs with accurate descriptions, locations, times, and hourly rates.
- Workers apply only for shifts they can genuinely commit to.
- A job posting is an invitation for applications, not a guaranteed placement.
- TapShift facilitates matching but is not a party to any employment or service agreement between users.
- Either party may decline or withdraw from a shift with reasonable notice communicated through the platform.
- Hourly rates and total compensation are agreed between worker and business at the time of application or offer.
- TapShift does not process, hold, or escrow payments — all financial transactions occur directly between parties.
- Workers and businesses are responsible for arranging payment according to agreed terms and applicable law.
- TapShift is not liable for disputes over payment, invoicing, or compensation.
- Reviews must reflect genuine, first-hand experiences and be factual and constructive.
- Reviews influence reputations — do not retaliate, extort, or post malicious content.
- TapShift may moderate, hide, or remove reviews that violate these Terms or Community Guidelines.
- Repeated poor ratings may affect your ability to use certain platform features.
- Use TapShift lawfully and in accordance with these Terms and our Community Guidelines.
- Do not attempt to disrupt, reverse-engineer, or compromise the platform or its security features.
- Do not use TapShift to solicit users off-platform or circumvent platform safety mechanisms.
- TapShift may suspend or terminate access for violations at its discretion.
- TapShift is provided on an 'as is' and 'as available' basis without warranties of any kind.
- We do not guarantee that a worker will be matched, a shift will be filled, or work will be completed.
- TapShift is not liable for the conduct, performance, or omissions of any user.
- To the maximum extent permitted by law, TapShift's liability is limited to the fees (if any) paid to us.
- Provide truthful, accurate information during registration and verification
- Maintain valid work eligibility and inform TapShift of any status change
- Communicate shifts, changes, and cancellations through the platform
- Respect confidentiality of documents and information shared via TapShift
- Arrange and honor payment terms agreed with the other party
- Comply with all applicable Berlin, German, and EU labor regulations
You may deactivate your account at any time. TapShift may suspend or terminate your access immediately if you breach these Terms, our Community Guidelines, or applicable law. Upon termination, your right to use the platform ceases, but provisions regarding liability, reviews, and governing law survive.
